TAMPA - State and federal investigators trampled privacy rights withoutjustification when they listened in on 65,000 telephone calls in thecomplex Key Bank fraud investigation, a federal judge said Tuesday. In a written opinion that "further amplifies" his earlier decision to suppress all wiretap evidence in the federal case against two former KeyBank officials and a customer, U.S. District Judge Clarence Newcomersharply criticized state and federal investigators.
"Approximately 65,000 calls and 1,123 hours of conversations were monitored. There appears to be no justification for such a massive invasion of so many individual expectations of privacy in confidentialbanking or personal telephone conversations," wrote Newcomer.
Judge Newcomer's oral ruling on March 26 effectively threw out all evidence in the federal case. It also dealt what may be the death blow to the investigation.
